Terms and conditions for purchase of eSIM products on site www.net2go.eu

1. INTRODUCTION

1.1. These Terms and Conditions constitute a legally binding agreement (“Agreement”) made between user on the website www.net2go.eu (“User“) and Telemach Hrvatska d.o.o. („Telemach“) with its registered office at Ulica Josipa Marohnića 1, in Zagreb, Croatia, concerning User's purchase of a prepaid eSIM product eNet2Go („eSIM product“) for use on User's personal device (“Device“).

1.2. These Terms&Conditions define the conditions under which Telemach sells eSIM product , and the conditions under which the User purchases eSIM product. By buying eSIM product the User fully accepts these terms and conditions defined herein. These terms and conditions are subject to change at any time and may be posted on the website www.net2go.eu, subject to applicable law.

2. PURCHASE OF AN eSIM AND ACTIVATION

2.1. The website www.net2go.eu allows purchase of eSIM product of Telemach. By purchasing an eSIM product on www.net2go.eu User enters into an agreement with Telemach for the purchase of the eSIM product.Top up of the eSIM product with currency is not available. The prices displayed for portfolio of eSIM products are in Euro and Croatian VAT is included.

Telemach reserves its rights to change or redraw eSIM product at any time, in accordance with applicable law.

During the purchasing process, the following information must be provided prior to purchase: Users's personal e-mail address for direct interactions and transactions on the website www.net2go.eu

2.2. Process flow of purchase and activation of eSIM product:

- User chooses eSIM product among listed products on website.
- User fills in e-mail address twice.
- Payment must be made by credit card (Visa, Mastercard, Diners) or by any other means of payment specified on the website.
- User enters payment details as required on the site per payment method and confirms purchase by clicking on purchase button.
- Telemach charges User’s credit card.
- Upon confirmed payment, Telemach sends payment confirmation and invoice to User's registered e-mail.
- Telemach sends all necessary details about eSIM product onto User’s e-mail.
- User downloads/installs eSIM onto his/her Device.

Through this action and by communicating his banking information at the time of the purchase, the User authorizes Telemach to debit his credit card of the amount indicated. The User confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In case of error, or inability to debit the card, the purchase is immediately canceled. When the User confirms the purchase, Telemach performs the process of debiting the User.

2.3. By purchasing eSIM product, the User acknowledges that he/she has an unlocked, eSIM-compatible Device, which is required in order to install and use the eSIM.

2.4. The credit card transaction will be processed and secured by Telemach-approved payment service providers.

3. DURATION AND TERMINATION

3.1. This Agreement shall commence once User purchases the eSIM product. All information for eSIM to be activated and used will be sent from Telemach to User's registered e-mail. After User downloads the eSIM from e-mail onto his/her Device, the eSIM product will be activated once eSIM is registered on Croatian or EU/EEA country mobile network.

The downloaded eSIM shall continue to remain on User’s Device after eSIM product has expired but it cannot be used nor top-up. The User may choose to remove the eSIM from Device settings at any time. However, it is recommended that the User does not remove the eSIM until eSIM product has been consumed or expired. The download of the eSIM products and the activation require stable internet connection.

3.2. The duration of the term of this Agreement will be the until the eSIM product has expired.

3.3. This Agreement will terminate immediately upon any of the following events occurring:

- consumption or expiry of the eSIM product.
- suspension by Telemach of the User’s use of the eSIM product as defined in these Terms and Conditions, Terms of Use and or other applicable laws, including but not limited to the breach of aforementioned rules, terms and/or laws.

If User does not delete the eSIM immediately from his/her Device upon consumption or expiry of the eSIM product, the eSIM shall be provided to User on an “as is” basis without a warranty of any kind. Telemach shall have no liability to User for such eSIM. If User purchases any further eSIM or eSIM product from Telemach, these Terms and Conditions shall accordingly apply.

4. WARRANTY

4.1. These Terms and Conditions are in addition to User's statutory rights as a consumer.

4.2. Telemach reserves the right, at its sole discretion, to discontinue the sale, provision or support of any eSIM product at any time, in accordance with applicable law.

5. REFUND AND RETURNS POLICY

5.1. User can apply to Telemach asking for refund within 14 days of purchase. Application for refunding can be done via site complaints@net2go.eu. User has to send invoice.

5.2. For a full refund from Telemach, the User must cumulatively meet the following requirements:
5.2.1. The eSIM must have been purchased from Telemach via the website ww.net2go.eu.
5.2.2. The eSIM must not have been activated.
5.2.3. The purchase of the eSIM must have been made no more than 14 dana prior to the request for a refund.

5.3. If applicable and approved, Telemach will provide User with a full refund in respect of an affected eSIM product with the same payment method used while purchased.

6. INTELLECTUAL PROPERTY RIGHTS

6.1. Except as otherwise indicated, the eSIM product is Telemach proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the website (collectively, the “Content”) and the trade marks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws or other intellectual property rights.

6.2. Except as expressly provided in these Terms and Conditions, no part of the eSIM product, Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

7. DATA PROTECTION

7.1. By purchasing an eSIM product, User acknowledges that Telemach will process personal information relating to User (“Personal Data“)

7.2. Under the GDPR and other applicable EU and Privacy and Data Protection legislation, you have rights over your Personal Data. You may for example, be entitled to ask us for a copy of your Personal Data, to correct it, erase or restrict its processing. These rights may be limited in some situations, for example if fulfilling your request would reveal Personal Data about another person, or where we can demonstrate that we have a legal requirement to process your Personal Data.

8. LIMITATION OF LIABILITY

8.1. To the extent permitted by law, Telemach excludes all liability (whether arising in contract, in negligence or otherwise), as permited by applicable law, for any loss or damage which may incur in connection with User's purchase of eSIM product. Notwithstanding the foregoing, Telemach’s liability under or in connection with this Agreement, whether arising from contract, negligence or otherwise shall in no event exceed the amount of charges payable by the User to Telemach under the relevant eSIM product.

9. GOVERNING LAW AND LEGAL COMPLIANCE

9.1. These Terms and conditions and all relations arising from or in connection with these Terms and conditions will be governed by and construed in accordance with the laws of Republic of Croatia.

9.2. The eSIM product and the website are not intended for use by any person or entity for which such use would be contrary to relevant law or regulation. Accordingly, persons who choose to purchase the eSIM product and/ or access the website if prohibited, do so on their own initiative and are solely responsible for compliance with applicable laws.

10. GENERAL

10.1. No failure or delay by either party to exercise any right or remedy under this Agreement shall be construed as a waiver of that right or remedy nor shall any single or partial exercise of any right or remedy preclude the further exercise of that right or remedy. No waiver by either party of any breach by the other of any provision of this Agreement shall be considered as a waiver of preceding or subsequent breach. The rights and remedies provided in under this Agreement are cumulative and are not exclusive of any rights or remedies provided by law.

10.2. This Agreement is drafted in the English language. In the event that there is a conflict between this English language version of the Agreement and any translated copies of the Agreement, the English version shall prevail.

10.3. For cases that are not resolved or regulated by these Terms and Conditions, the General Terms and Conditions of Telemach and the applicable regulations will be applied accordingly.

10.4. Telemach reserves the right to change these Terms and Conditions e, about which the user will be notified in a timely manner through the Telemach website or in another appropriate way.
